DREAMKEEP REWARDS PROGRAM TERMS AND CONDITIONS
I. General Information
These Terms and Conditions apply to access to, and participation in, the DreamKeep Rewards Program ("DreamKeep Rewards" or "Program"), which is operated by American Family Mutual Insurance Company, or its subsidiaries, licensees and affiliated companies (collectively, "American Family") in the State of Illinois.
American Family may amend or modify these Program Terms and Conditions at any time, and continued participation in DreamKeep Rewards constitutes acceptance by the participating DreamKeep Rewards Member ("Member") of these Terms and Conditions and any such amendments or modifications. Program Members are responsible for reviewing, understanding, and abiding by these Terms and Conditions and any such changes.
Program Eligibility: Participation in the Program is open to American Family customers and noncustomers. To be eligible, individuals must:
- Be legal residents of the State of Illinois.
- Be 18 years of age or older.
- Not have been previously terminated from the Program by American Family due to fraud, abuse, or use of the program not as intended by American Family.
- Not be a corporation, organization or legal entity.
By participating in the Program, a member represents that he or she meets these membership criteria.
Households: For purposes of these Terms and Conditions, an "American Family Household" is defined as Program eligible individuals who reside at the same residential address and who have been determined by American Family to be part of the same household. A "Loyalty Household" is defined as all individuals within an American Family Household who enroll as Members in DreamKeep Rewards.
American Family, at its sole discretion, determines which individuals constitute an American Family Household, and American Family may combine or separate American Family Households and/or Loyalty Households or separate individuals into multiple American Family Households and/or Loyalty Households at any time.
Membership Identification: DreamKeep Rewards Members ("Members") will not be provided a membership ID. Instead, Members will utilize their My Account log-in credentials to access the DreamKeep Rewards website.
Verification: Each potential Member may be required to prove eligibility, including, without limitation, proof of age and residence within three (3) days of being requested to do so. In the event of non-compliance by a potential Member, if he/she is found to be ineligible or if he/she cannot or does not comply with these Terms and Conditions, such potential Member shall be disqualified and all privileges otherwise due as a Member shall be terminated.
III. Earning Points
Points accrue and are redeemed at a Loyalty Household level, regardless of which Member earns or redeems the points.
There are four ways for Program Members to earn points in DreamKeep Rewards:
- Hold an eligible American Family insurance policy
- Be a customer of American Family for a period of time
- Complete a Qualifying Activity (defined below)
- Complete a Targeted Offer
Hold an eligible American Family insurance policy
A Loyalty Household earns points for each eligible policy ("Policy Points"). An Eligible Policy meets the following criteria:
- Is an active American Family personal insurance policy. An "active policy" is defined as a policy in good standing, providing insurance coverage on behalf of a Member
- Has at least one Active Member in one of the following roles on the policy: policyholder, named insured, additional insured, owner, co-owner, or additional owner. An "Active Member" is a Member whose membership account is not inactive, cancelled or closed as described in Section V below.
- Is one of the following policy types: Auto, Homeowners, Renters, Life, Personal Umbrella, Boat, and Recreational Vehicle. Commercial policies are not eligible.
- The policy covers risks located in the state of Illinois.
If an Eligible Policy has named insured individuals as Members in two separate AFI Households, only one of the corresponding Loyalty Households will receive points, as determined by the first named insured who joined the Program.
Policy Points accrue daily. The number of points awarded for each policy type varies and is published on the DreamKeep Rewards website.
Be a customer of American Family for a period of time
For each year as an American Family household, a Loyalty Household with qualifying policies is eligible to earn "Tenure Points". For the purpose of calculating Tenure Points, "Tenure" is defined as the total number of years that has elapsed since the oldest start date on any qualifying policy for any individual in the American Family Household (the "Tenure Date"). The Tenure is multiplied by the number of points earned per year of Tenure to calculate the total number of Tenure Points earned annually.
Tenure Points accrue annually and will be posted within thirty days after the anniversary of the Tenure Date. The number of points awarded for each year of Tenure is published on the DreamKeep Rewards website.
It is the Member’s responsibility to notify American Family promptly of any error in AFI’s calculation of tenure. AFI is not responsible for any errors in its calculation of Tenure Points, and is not liable to reimburse Membership Households for any discrepancies between the number of Tenure Points awarded and the number of Tenure Points that should have been awarded.
Complete a Qualifying Activity
Loyalty Households may earn points and/or Kudos for completing Qualifying Activities. A "Qualifying Activity" is an action or task predefined by American Family, which is eligible to earn points and/or Kudos upon completion and verification.
Activity attributes may vary by Qualifying Activity. The attributes for each Qualifying Activity can be found on the DreamKeep Rewards website. These attributes include:
- The number of points awarded for completion, if applicable
- Whether or not a Kudo is issued upon completion
- The time frame with which a Qualifying Activity may be completed
- Whether or not the Qualifying Activity may be completed once within the permitted time frame by (a) every Member within a Loyalty Household or (b) only once per Loyalty Household
- The preexisting Eligible Policy(-ies) required, if any
- How to complete the Qualifying Activity and verify such completion
American Family may add or remove a Qualifying Activity at any time.
Qualify for a Targeted Offer
From time to time, DreamKeep Rewards offers additional opportunities for Loyalty Households to earn points ("Targeted Offers"). The terms for each Targeted Offer may vary, and are provided when the Targeted Offer is presented to the qualifying Member or Loyalty Household. American Family, at its sole discretion, may determine which Members and Loyalty Households are eligible to participate in any given Targeted Offer.
IV. Redeeming Points
Any Member within a Loyalty Household may redeem points. American Family is not responsible or liable for household disputes regarding eligibility of Members of a Loyalty Household to redeem points from their respective Loyalty Household’s consolidated points balance.
Points may be redeemed for products and services ("Rewards") from the online Rewards catalog on the DreamKeep Rewards website. The number of points required varies by Reward and is displayed at time of ordering. Applicable sales tax and shipping and handling fees will be covered by the points redemption. Point redemption values are subject to change at AFI’s sole discretion, and all Rewards are subject to availability. American Family may add or remove Rewards as redemption options at any time.
Upon the redemption of points, Rewards may be fulfilled as physical merchandise mailed to the Loyalty Household address or a shipping address within the Continental U.S. explicitly provided by the Member at time of placing the order. Rewards will not be delivered to P.O., A.P.O. or F.P.O. addresses. Once the order has been placed, the address cannot be changed.
Physical merchandise Rewards will be fulfilled using first class mail. Digital Rewards will be fulfilled real time to the Member upon redemption and Digital Reward codes will be stored in the Member’s Account History on the website.
Once a physical merchandise Reward is delivered by mail, the Member has 30 days to return the Reward by mailing it back to the American Family fulfillment vendor in its original packaging with the “Here’s Your Reward” Reward Certificate for a full points refund. Contact an American Family Insurance DreamKeep Rewards Care Center Representative at 1-844-YOU-KEEP (1-844-968-5337) to initiate a return. Points will not be refunded for returns of physical merchandise after 30 days or for merchandise that has been altered in any way. For physical Gift Card rewards mailed to a Member or digital Rewards ordered by a Member there are no returns available and points will not be refunded for any reason. For donation Rewards such as the American Family Insurance Charity Partner, your redemption is nonrefundable and the Reward cannot be canceled or returned.
Points have no cash value and are nontransferable. Kudos awarded by DreamKeep Rewards have no cash or point value.
Some Rewards are provided by partners, and American Family provides only the access and the technical platform for Members to redeem awards directly from those partners. American Family will not become party to any transaction between a Member and a Loyalty partner. Consequently, American Family strongly encourages Members to check the separate terms and conditions of the partner prior to redeeming any award. As a condition of obtaining rewards from these partners, Members agree to abide to such separate terms and conditions, including but not limited to, rules and restrictions on availability, shipment and delivery terms, notification of defects, return and refund policies, money back guarantees and claims for damages.
V. Membership Inactivity, Closure and Cancellation
A Loyalty Household account becomes Inactive upon 18 consecutive months of no Qualifying Transactions by any of the Loyalty Household Members. "Qualifying Transactions" include:
- Completion of a Qualifying Activity toward earning a Kudo and/or points
- Redeeming points for a Reward
Earning Policy Points, Tenure Points or points through a Targeted Offer do not count as Qualifying Transactions.
When a Loyalty Household account becomes Inactive, the following occurs:
- Any unused points are forfeited and the Loyalty Household points balance is set to zero.
- No further Policy Points or Tenure Points will be earned until a Qualifying Transaction occurs.
After a Loyalty Household account has not earned or redeemed points in three consecutive years, American Family reserves the right to close the Loyalty Household account and all corresponding Member accounts. Should an Inactive Member wish to reactivate the Loyalty Household account that has lapsed due to inactivity, he/she must join the program again. In the event that a Loyalty Household Account is reactivated under this section, the account will begin with a zero balance of reward points, and points previously earned but forfeited remain forfeited.
Members may choose to cancel their individual Member accounts and Loyalty Household account by contacting 1-844-968-5337. All program benefits, including all accrued points, will immediately be forfeited upon cancellation.
Participation in the Program is a privilege granted to Members, and as such can be suspended, revoked or terminated at any time by American Family for any reason. In the event of termination of Membership, all program benefits, including all accrued points, will immediately be forfeited.
American Family reserves the right in its sole discretion to disqualify any Member from participating in the Program that American Family finds to have tampered with the process of earning points and Rewards or the operation of the Program; to be acting in violation of these Terms and Conditions; or to be acting in a fraudulent or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or to have provided inaccurate information on any legal documents submitted in connection with the Program.
VI. Member Communications
By becoming a Member, Members agree to receive administrative communications regarding DreamKeep Rewards from American Family via print, email and other means.
Members may also choose to receive or not to receive loyalty marketing communications from DreamKeep Rewards by selecting to do so at www.amfam.com/dreamkeep, by sending an email to DreamKeep@amfam.com, or by telephone at 1-844-968-5337. Consenting to receive such loyalty marketing communications is optional and does not have to be agreed to in order to be eligible to enter the Program. If at any time a Member notifies American Family that he or she does not want to receive promotional information via email, American Family will not contact the individual directly through email with promotional messages about DreamKeep Rewards. However, American Family may continue to send the Member program-related administrative communications, such as transaction history and account statements.
A Member may view account activity online at the DreamKeep Rewards website or by contacting 1-844-968-5337.
Members recognize and acknowledge American Family’s exclusive ownership of its Intellectual Property. For purposes of these Terms and Conditions, Intellectual Property means trademarks, service marks, trade dress, logos, trade names, internet domain names and corporate names, together with all translations, adaptations, derivations and combinations thereof, and all other identifying indicia; all works of authorship and copyrights; all inventions (whether patentable or unpatentable) and all patents; all trade secrets and confidential business information; all software and firmware (including data, databases and related documentation); and all documents, records and files relating to all intellectual property described herein. Members will not claim, directly or indirectly, any right, title or interest in or to American Family’s Intellectual Property, or take any other action adverse to American Family’s right or interest in its Intellectual Property.
American Family is not responsible for communications and account information lost due to change of contact information.
DreamKeep Rewards offers additional special member benefits. Use of each of those benefits is subject to its own terms and conditions.
These Terms and Conditions do not alter in any way the terms or conditions of any other agreement Members may have with American Family for products, services or otherwise.
Points and Rewards may not be sold, transferred or assigned to, or shared with others outside of the Members of the Membership Household.
American Family reserves the right to change, modify and/or eliminate DreamKeep Rewards and/or these Terms and Conditions or any policy or guideline pertaining to DreamKeep Rewards at any time and in its sole discretion without notice to Members. Any changes or modifications will be effective immediately upon posting the revisions to the DreamKeep Rewards website, and Members waive any right they may have to receive specific notice of such changes or modifications.
From time to time, DreamKeep Rewards presents offers to Members from other companies. The terms of those offers are provided at the time of the offer. American Family is not responsible or liable for disputes regarding these offers or by use of the products or services.
Members are responsible for consulting with a certified contractor before taking any action that includes technical or potentially hazardous installation.
American Family and each of its affiliates, subsidiaries, and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, "Releases") are not responsible for: any incorrect or inaccurate text messaging or entry of information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to Member’s or any other person's cell phone device relating to or resulting from participation in this Program; inability to submit or access any email or text message; theft, tampering, destruction, or unauthorized access to, or alteration of Member emails or texts; emails or texts that are processed incorrectly or are incomplete or lost due to cellular device, computer or electronic malfunction or traffic congestion on the Internet or on any web site, and/or cellular telephone lines; printing or other errors; or theft or destruction or corruption of emails or texts.
If, for any reason, the Program is not capable of running as planned, including, without limitation, amendment and/or adoption of new or existing laws and/or regulations regarding the administration, operation or any other aspect of the Program in any jurisdiction, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of American Family which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Program, American Family reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program. Should the Program be terminated pursuant to this paragraph, notice will be posted on the Web. No software-generated, robotic, programmed, script, macro or other automated online messages or text messages are permitted and will result in disqualification of all such applicants. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, AMERICAN FAMILY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE WISCONSIN COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE PROGRAM AND THE LAWS OF THE STATE OF WISCONSIN SHALL GOVERN THE PROGRAM. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
IX. General Reward Terms
All costs and expenses not specifically included as part of the Rewards are solely each Member’s responsibility. The value of the Reward will be taxable to each Member as income. Each Member must supply American Family with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of each Member for the actual value of a Reward received in excess of value of $599.00. Upon entry into the Program, the Member is required to comply with any and all applicable federal, state, and local laws, rules, and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Terms and Conditions, including expenses incurred by accepting a Reward, are solely each Member’s responsibility. American Family shall have no responsibility or obligation to a Member who is unable or unavailable to accept or utilize a Reward as described herein.
X. Limitations of Liability
YOU UNDERSTAND AND AGREE THAT YOU SHALL HAVE NO RIGHT TO ENJOIN OR RESTRAIN THE DEVELOPMENT, PRODUCTION, ADVERTISING, PROMOTION, DISTRIBUTION OR EXPLOITATION OF THE PROGRAM OR AMERICAN FAMILY. IN NO EVENT WILL AMERICAN FAMILY, OR ITS, AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "RELEASEES") BE RESPONSIBLE FOR ANY CLAIMS, ACTIONS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS AND EXPENSES (INCLUDING, ATTORNEYS' FEES) OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE, ARISING OUT OF YOUR PARTICIPATION IN THE PROGRAM, THE ACCEPTANCE, POSSESSION, USE, MISUSE, LOSS OR MISDIRECTION OF A REWARD, PARTICIPATION IN ANY PROGRAM-RELATED ACTIVITIES OR ACCESS TO AND USE OF ANY INTERNET SITE. ENTRANTS AGREE TO RELEASE, DEFEND, INDEMNIFY, DISCHARGE AND HOLD HARMLESS AMERICAN FAMILY FROM ANY SUCH CLAIMS, ACTIONS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS AND EXPENSES, INCLUDING, WITHOUT LIMITATION FROM ANY DAMAGE, INJURY, DEATH, LOSS OR OTHER LIABILITY EITHER AT LAW OR EQUITY WHETHER KNOWN OR UNKNOWN, ASSERTED OR NOT ASSERTED THAT MAY ARISE FROM OR IN ANY WAY RELATE TO YOUR PARTICIPATION IN THE PROGRAM OR THE AWARDING, ACCEPTANCE, USE OR MISUSE OF ANY REWARD. WITHOUT LIMITING THE FOREGOING, THE PROGRAM, THE REWARDS AND MATERIALS ARE PROVIDED "AS-IS" WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
